Acceptance of Terms

  • •By accessing or using Sansparsh Wellness platform, you agree to be bound by these Terms of Service.

  • •We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance of the new terms.
  • •You must be at least 13 years old to use our services. If you are under 18, you must have parental consent.

Account Registration

  • •You are responsible for maintaining the security of your account credentials.
  • •You must not share your account with others or allow unauthorized access.
  • •You agree to notify us immediately of any unauthorized access or security breach.

Services Provided

  • •Sansparsh Wellness provides yoga classes, wellness programs, video sessions, and related services.
  • •Class schedules, instructors, and availability are subject to change without notice.
  • •We strive to provide accurate information but do not guarantee the completeness or accuracy of all content.
  • •Services are provided 'as is' and we make no warranties regarding uninterrupted or error-free service.
  • •Virtual/online classes require a stable internet connection, which is your responsibility.

Payments and Subscriptions

  • •All prices are in Indian Rupees (INR) unless otherwise stated.
  • •Subscription fees are charged on a recurring basis according to your chosen plan.
  • •You authorize us to charge your payment method for all fees incurred.
  • •Failed payments may result in service interruption or account suspension.
  • •We reserve the right to change pricing with 30 days' notice to active subscribers.
  • •Promotional offers and discounts are subject to specific terms and conditions.

Cancellation and Refunds

  • •You may cancel your subscription at any time through your account settings.
  • •Cancellation takes effect at the end of your current billing period.
  • •No refunds are provided for partial months or unused class credits.
  • •Class cancellations must be made at least 2 hours before the scheduled start time.
  • •Late cancellations or no-shows may result in forfeiture of class credits.
  • •Refund requests are evaluated on a case-by-case basis for exceptional circumstances.

Health and Safety

  • •Yoga and wellness activities involve physical exertion and carry inherent risks.
  • •You are responsible for assessing your own fitness level and consulting healthcare providers before participation.
  • •Inform instructors of any injuries, medical conditions, or physical limitations.
  • •You participate in classes at your own risk and must follow instructor guidance.
  • •Sansparsh Wellness is not liable for injuries sustained during participation in our programs.
  • •If you feel pain or discomfort during a class, stop immediately and seek medical attention if needed.

Intellectual Property

  • •All content on the platform, including videos, images, text, and logos, is owned by Sansparsh Wellness or licensed to us.
  • •You may not copy, reproduce, distribute, or create derivative works without written permission.
  • •Class recordings and materials are for personal use only and may not be shared or redistributed.
  • •User-generated content remains your property, but you grant us a license to use it for platform purposes.
  • •We respect intellectual property rights and will respond to valid copyright infringement claims.

Prohibited Conduct

  • •You may not use the platform for any illegal or unauthorized purpose.
  • •Harassment, abuse, or threatening behavior toward staff or other users is prohibited.
  • •You may not attempt to gain unauthorized access to our systems or other user accounts.
  • •Uploading viruses, malware, or malicious code is strictly prohibited.
  • •You may not impersonate others or misrepresent your affiliation with any person or entity.
  • •Commercial use of the platform without authorization is not permitted.
  • •Scraping, data mining, or automated data collection is prohibited.

Limitation of Liability

To the maximum extent permitted by law, Sansparsh Wellness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • •Any unauthorized access to or use of our servers or personal information
  • •Any interruption or cessation of services
  • •Any injuries or health issues arising from participation in our programs

Indemnification

You agree to defend, indemnify, and hold harmless Sansparsh Wellness, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your infringement of any intellectual property or other rights.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or our services:

  • •You agree to first attempt to resolve the dispute informally by contacting us.
  • •If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with Indian law.
  • •The arbitration shall be conducted in English in a location mutually agreed upon.
  • •You waive any right to participate in class action lawsuits or class-wide arbitration.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in India, and you hereby consent to personal jurisdiction and venue therein.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sansparsh Wellness regarding the use of our services and supersede all prior agreements and understandings, whether written or oral.
